General Terms and Conditions of Sale (GTC) – Mobinova

1. Purpose

These General Terms and Conditions of Sale govern the commercial relationship between Mobinova and its B2B and B2C clients for the purchase of mobile accessories via our e-commerce site or direct contact. Any order implies full acceptance of these GTC.


2. Products

Mobinova offers premium yet accessible mobile accessories, imported from certified OEM/ODM manufacturers according to the provided catalog. Product information (description, features, availability, compatibility) is for reference only and does not constitute a contractual guarantee. Mobinova reserves the right to modify specifications or discontinue products without notice.


3. Orders

Orders may be placed:
Via our e-commerce website
Through direct contact (WhatsApp, email, phone)

Mobinova reserves the right to refuse any order for legitimate reasons, including product unavailability, unidentified client, prior disputes, questionable solvency, or orders deemed unethical.

4. Pricing

Prices listed on the website or in the catalog are in Tunisian Dinars (TND) and include all applicable taxes (TTC).
Mobinova reserves the right to adjust prices at any time. Confirmed orders are invoiced at the agreed price.
Shipping, customs, and any additional charges remain the client’s responsibility unless otherwise agreed in writing.


5. Payment

Payments may be made via:

  • Click to Pay on the e-commerce website
  • Payment at the post office
  • Payment on delivery (Cash on Delivery – COD)

Mobinova reserves the right to suspend or cancel delivery in case of non-payment or incomplete payment. Late payments incur automatic legal penalties and may result in order suspension.

6. Delivery

Deliveries are made to the address provided by the client and will be outsourced to a partner shipping company.
Mobinova commits to dispatch products within the agreed timeframe, subject to availability, logistics, and force majeure.
Risk of loss or damage transfers to the client upon handover to the carrier. The client bears responsibility for any damage, loss, or delay after transfer.


7. Receipt and Claims

Clients must inspect products upon delivery.
Any claim regarding defective or non-compliant products must be made within 48 hours of delivery. Products must be returned in their original packaging and resaleable condition to be eligible for replacement or correction.


8. Liability

Mobinova is not responsible for indirect damages, loss of revenue, or consequential losses arising from product use or delivery service. Mobinova’s liability is strictly limited to the replacement or refund of defective products.


9. Ownership and Trademarks

Products remain the property of Mobinova until full payment is received. Any reproduction, copying, use, or modification of Mobinova’s or its partners’ trademarks, logos, or content is strictly prohibited without prior written authorization.


10. Confidentiality and Personal Data

Information provided by clients is processed in accordance with Tunisian data protection laws. Clients agree not to disclose commercial information obtained from Mobinova to third parties.


11. Force Majeure

Mobinova shall not be liable for non-performance or delays due to events beyond its control, including natural disasters, strikes, epidemics, government restrictions, or transportation disruptions.


12. Governing Law and Disputes

These GTC are governed by Tunisian law. Any dispute relating to the interpretation or execution of these terms shall be submitted to the competent courts of Tunis, even in the case of multiple defendants or urgent proceedings.
